Terms of Service

By accessing and using the website of SOMOS CACAO SAS BIC, Tax ID (NIT) 901.147.618-1, and by making purchases in our online store, you accept the following terms and conditions of service. These conditions describe the rights and responsibilities of both SOMOS CACAO SAS BIC (hereinafter also "the Company" or "we") and you as a user or customer of our online store.

• Order acceptance: All purchase orders placed through our site are subject to verification and acceptance by SOMOS CACAO SAS BIC. The automatic processing of an order on the site (e.g. generation of an order confirmation or charge) does not imply definitive acceptance of the transaction by the Company. We reserve the right to reject or cancel an order in cases such as: unavailable inventory, inaccurate product information (price or description), suspected fraud, or exceptional situations. If we reject or cancel an order after receiving payment, we guarantee a full refund of the amount paid, which will be processed as soon as possible. We will notify you of any cancellation or adjustment of your order by email or at the contact phone number registered.

• Prices and typographical errors: SOMOS CACAO SAS BIC strives to ensure that all prices and product descriptions published on the site are correct. However, if we discover an error in the price or information of a product, we reserve the right to correct it and to cancel or adjust any order affected by that error, even if the order had already been confirmed. In that case, we will inform you of the situation; you may choose to confirm the order at the corrected price or cancel it. Prices are expressed in Colombian pesos (COP) and include applicable taxes (such as VAT) unless otherwise stated. Shipping costs, where applicable, will be added at the end of the checkout process (see Shipping Policy) and shown before you complete payment.

• Payment methods: We accept the payment methods indicated in our payment gateway (credit cards, debit cards, transfers or other available local methods). All payments are subject to verification and authorization by the issuing financial institution. If the issuer of your card or payment method does not authorize the charge, we will not be able to process your order. SOMOS CACAO SAS BIC is not responsible for delays or failures in delivery due to lack of payment or transaction authorization problems.

• Shipping and delivery: The terms related to shipping (territory, times, costs) are detailed in the Shipping Policy section below. We make our best effort to meet the estimated delivery times, but we do not guarantee exact dates, since delays may occur for logistical, weather or force majeure reasons. The risk of loss or damage to the product passes to the customer at the moment the customer (or a designated third party) physically receives the product.

• Product quality guarantee: Our Tree to Bar chocolates are high-quality artisan products. We guarantee that they will be dispatched in optimal manufacturing condition. However, because of their nature, we do not offer a satisfaction guarantee based on personal taste or preferences. If a product shows verifiable quality defects (other than melting, see Returns Policy), please contact us immediately so that we can review your case in accordance with our returns policy and the legal warranty. Please note that minor variations in flavor, color or shape are normal in artisan products and do not constitute quality defects.

• Limitation of liability: To the extent permitted by law, SOMOS CACAO SAS BIC shall not be liable for indirect, incidental, special or consequential damages arising from the use of our site or from the purchase or use of our products. This includes, without limitation, loss of income, loss of profit, consequential losses, damages for lost expectations, or other intangible damages. The total aggregate liability of SOMOS CACAO SAS BIC toward the customer, on any grounds (whether contractual, extra-contractual, strict liability, etc.), shall in no case exceed the total amount actually paid by the customer for the product or service that gave rise to the claim. SOMOS CACAO SAS BIC assumes no responsibility for delays or failures caused by events beyond our reasonable control (force majeure or acts of God, such as transport accidents, strikes, natural disasters, acts of authority, supplier failures, etc.), but we undertake to inform the customer promptly and to seek reasonable solutions in such cases.

• Intellectual property: All content on the SOMOS CACAO SAS BIC website (including, but not limited to, texts, product descriptions, photographs, logos, graphics, designs, icons, videos and any other material) is the property of SOMOS CACAO SAS BIC or its licensors, and is protected by copyright, trademark and other intellectual property laws. It is strictly prohibited to copy, reproduce, distribute, publish, transmit, modify or create derivative works from our content without the prior written authorization of SOMOS CACAO SAS BIC. Unauthorized use of our materials may result in civil and criminal legal action under current legislation. SOMOS CACAO SAS BIC reserves the right to restrict or block access to the site (including canceling user accounts), temporarily or permanently, if we detect activities that violate these terms or our privacy policy, or that in any way harm the experience of other users or the operation of the platform.

• Comments and user-generated content: If our website at any time allows comments, product reviews or other user-generated content, it must be respectful and truthful. We reserve the right to moderate, edit or remove any content submitted by users that we consider inappropriate, offensive, defamatory, obscene, spam, false, or that infringes the rights of third parties. By posting content on our site (for example, a review), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display that content for the operational and promotional purposes of the store. In the event of substantial changes, we will publish the updated version in this section of the site and indicate the date of the last update. We recommend reviewing the terms periodically. Continued use of the site after changes are published constitutes acceptance of the new terms. If you do not agree with any modification, you must stop using the site immediately. No modification will adversely affect consumers' acquired rights for purchases already made; changes will apply going forward.
